Either way the law is the same. Also, there was a designer/artist who created the characters in the first place. The same rules apply to photographs, if they don't say you can use someone's photograph for commercial use, you can be sued.
Also, Disney and other places do offer scrapping kits I have seen them

They just aren't all over or as easily found
